View Full Version : HELP!My ex-wife got arrested 1300 miles away and my kids are in foster home.

I desparately need advice!

My ex-wife has successfully prevented my visitation for 7 years by
hopping around Michigan and falsley alleging abuse. She has always
alleged indifference on my part. In the meantime she's had 3 more
children (a total of 5 children with at least 4 different fathers) and
needs to be psychologicaly evaluated. She has had no regard for court
ordered visitation and has always believed that judges' decision did
not apply to her. One of the other fathers was somewhat more
successful than me in obtaining enforcement. My experience has alway
been negative with the family court system in MI.

She ran away to Colorado last year (without my knowlege) and didn't
return to Michigan as ordered. I recieved a call Friday (10/31/03)
from CO informing me that she's in jail for parental kidnapping and
violating the judges orders in her latest custody battle and my little
girls have been placed in a foster home. The custody of 2 of the other
3 children will go to their father, the complaintant in that case and
my girls are going to remain.

Her mother in Co will likely put up some kind of fight to keep them
there.

What are her chances. Anybody know anything about interstate custody.

Why do you think a Usenet newsgroup can help better than a decent child
care lawyer? At best ppl can share their (varied) experiences, none of
which will help you very much.

Lawyers in the states concerned know about Interstate custody issues ...
really, apart from sympathising, no one else can do very much.

What has their advice been?

You need to get an attorney immediately, have him file an emergency order
with the judge granting you temporary full custody. Take the order and get
your butt out to CO immediately to pick up the kids. Drive time to Co is
about 22 hrs. I would suggest a nice rental car with unlimited mileage.
Had to do a very very similar thing going to Ca. from MI a few years ago.
Do it Immediately. If you don't already have one, you need to contact the
Mich. branch of National Congress for Men and Children, or Fathers for Equal
Rights for a referral of an attorney. Do it NOW!!!! Email me privately if

I have temporary full custody of my kids. It has cost me everything from a
material perspective but the kids are safe - and alive. Their mom may get
better in the future but for now the kids are safe. I would suggest you drop
everything and do what you need to do to get your kids.

Get a lawyer and go get those kids no matter what. Who knows what kind of
people your kids are with right now??? I only hope you don't get this
message because you already left to get them.

Been there, done that. Since your daughters are in foster care, CPS is
involved. I assume it was CPS in Colorado that contacted you. Grit your
teeth, this is gonna take awhile. There's something called an "Interstate
Compact" which allows CPS in one state to do investigations on behalf of CPS
in another state. See if they'll set you up for that. Then you can work
with your local CPS people instead of having to practically live in
Colorado. They'll do a "home study" in which they come to your house,
interview you and anybody else that lives with you, they'll ask for and talk
to references, check your criminal and credit background, ask for paycheck
stubs, past IRS forms, etc., etc., etc. During this process, ask for
visitation - you'll probably have to go to Colorado for this, or at least
foot the airline bill if your kids are old enough to travel by themselves.
It's frustrating and will take a lot of time.

In my case, the home study took almost 6 months, and I was allowed monthly
visitation (supervised at CPS in Idaho initially). Toward the end of the
six months, I was on good terms with the foster family, and could write and
phone. When the home study was "nearly" complete, they approved an
"extended" visit, where my daughter came to Texas. During the time she was
here, the home study was completed, placement with me was recommended, and
CPS got their noses out of my life.

Six months later, I petitioned the court in Idaho for full custody, and it
was granted.
