Advice on Child Support Wrongdoing.
 
So here is the situtuation, and I need some serious advice about it.

In 1997, I moved to my dads house in TX and my parents had all child
support charges dropped and turned into joint custody, and all child
support charges are now void. We have documentation of that.

So in the middle somwhere, Between TX and IL, Child support charges
were NOT dropped. They have been taking money out of my dads check for
almost ten years now that i've been living with him. He's been to
court, and had it dropped AGAIN. There is documentation on this too.
But the funny thing, is that my mom has never gotten a check from the
child support agency since the first court date.

Just this saturday, they sent us a message saying they were going to
levey our possessions to pay for the child support. They have also been
taking my fathers income tax. There has been 2 letters, each with
incorrect values of how much we owed left.

We're speaking with an attourney yet again, but now i'm 18. I was
wondering if I could sue the state of IL for the money they owe ME. The
money that was not sent to my birthmom out of my dads checks and income
taxes. I've been living like crap because of this stupid ordeal, and
i've had to pay for my own things I needed. I have crappy job working
at a computer store and I have got my own car, I buy my own clothes,
pay my bills, and I can't pay back student loans for college. I'm
blaming the state of IL, becase they have screwed over my family
royally, and I was wondernig if I could get it back.

They are still charging him, for your information. And i'm going to be
19 in may.

Evidently, his Dad.

Not sure if this is just a wishful troll or not, but I say he should
definitely talk to a lawyer about suing. Sounds like Illinois got a
little too greedy about abusing the nice racket they have, and is now
left with its pants down. How are they going to justify doing what they
did when the CHILD they were supposed to be servicing shows up in court
demanding the money that they stole? "Everyone knows" that NCP dads are
all liars and deadbeats, but this isn't an NCP dad making a stink about
their thievery, it's a "child".

Yes, please, talk to a lawyer about the best way to sue them. If the
lawyer tells you it's never been done before and that it isn't possible,
find another lawyer. Call a reporter from the local paper, too -- they
won't care about what your father has to say, but they may well care
about YOUR side of the story. And please keep us informed here about
what happens.

My state of Rhode Island trumped up hundreds of dollars that I
supposedly "owed" and made off scott-free with it, effectively stealing
it from my son because the money never went to his mother either.
They're crooks, plain and simple, but when they blatantly steal from
kids like this they leave their pants down as I said. One of the big
reasons they are allowed to keep up their shenanigans is that the public
believes that they are helping children -- when the children begin to
call them on their schemes, it will go a long way towards educating the
public at large about what they are really all about.

Three points -

1. If your "birthmom" was ever on public assistant the state could be
seeking reimbursement for whatever benefits she received and that would
create the situation where you claimed the money paid did not go to her.
2. If any CS arrearage existed when the agreement to end CS was made the
remaining balance plus interest could still be outstanding. Stopping the
accrual of CS does not make past due amounts go away.
3. You have no rights to the CS. Only the judgment creditor has a legal
claim to CS money. Based on what you have posted, only your birthmom or the
state has that legal claim.

They shoud at least be accountable where the money was sent, unless as you
say the mother was on welfare all these years?

child support payments (we withheld from his check as ordered) did not
seem to be reaching the mother (she called every month screaming at
me) was that there was somehow two cases in her name, but both with
the same docket number. When the money came in, it was automatically
funneled to a holding account because of the conflict. We were told
how she could straighten it out and I conveyed this to her, but I
don't know if she did it. I DO know that she is currently claiming an
arrearage which does not exist... at least from Dad's end.

I tell you this because it may be possible that there is a similar
snafu in your situation. The "void" order may have reached the child
support agency and someone may have set it up as a separate case.
This is something only your mother can fix and, I have to tell you, I
don't understand why I don't hear about your mother's involvement in
fixing this and how it has gone on so long. UNLESS, she has been
getting the money and doesn't want you to know. Is THIS a
possibility?

It's odd how you say "levy OUR possessions." You are 18 and legally
own everything you own now. They can't levy YOUR possessions.

You are 18. You SHOULD be taking responsibility for yourself now...
even if you have a crappy job. Why are you concerned about paying
back student loans for college now? Supposedly, you will educate
yourself in a manner in which your future income can handle the load.
The wonderful thing about Federal Direct Student Loans is that they
offer an income contingent repayment plan so, if you don't get your
dream job after college, you should never have to pay more than you
can afford.

At this point, the money is owed to your father. He may wish to give
some of it to you, but that is his choice. He DID provide for you
whether it was in the lifestyle he could have afforded without his
income being withheld or not. He may have forfeited saving for
retirement just to make it on what was left.

I understand that you are angry having had to live a life more shabby
than your father's income would have warranted, but you made it and
your entire life is ahead of you for YOU to make it what you will. No
amount of money now will fix what you experienced growing up and,
other than a desire to get it back to the rightful owner (your father)
who may or may not allow you to benefit from it, you have no recourse.

I know the money should go to my family, because they've been
supporting me over the years with their own hard work. I just want all
the harrassment and faulty charges gone, and if I can get some money
back that was misdirected, that would be of great help.

I can honestly say that I'm not sure if my mom is embezzling the money
or not, but I really hope that we can figure out what has happened.
If we can expose the child support agency for wrongdoing, then that
would be good enough for me. We have very good proof that the
book-keeping is changing dramatically.
