Hi All,
I seperated from my husband in Jan 06. We have NO paperwork whatsoever.. I
have our son like 65% of the time. He just started paying child support.
Does anyone know how strict New York is with regards to this? I know the
norm is 17%, which he is NOT paying. Says he cant because he wants to
keep
the house we were in and cant afford that and to pay 17%. If this goes to
court what are my chances of getting 17% of his gross??? Thanks for any
answers...

Are you not able to care for your child on what he pays you? Perhaps a
better solution would be 50/50 custody to take some of the financial
pressure off of you. Maybe the 2 of you could sit down and work that out.

Yep, agreed, and would be much better for your child as well. It's
certainly possible to do, I've been doing it for over 6 years now.

'Course, the courts still think I should pay her full standard child
support, if she gets on Welfare... but that's here in RI.
