'Deadbeat Dad' sentenced to 10 years in ADC

History was made in Hot Spring County Monday, when Judge Phillip
Shirron presided over a case in which a father did not pay child
support. This was the first such case in the Seventh Judicial Circuit.
David Briggs, 38, was convicted of not paying child support in the
amount of $14,556.60, and he was sentenced to 10 years in the Arkansas
Department of Corrections. According to testimony, Briggs was ordered
to pay $49 a week in child support to his former wife, Tina, to help
support their then 12 year old daughter. Tina Briggs said that her
ex-husband started out paying the money. "He would get behind and then
catch up," she said. Unfortunately, he did not continue to pay.
According to Terry Daily with Child Support Enforcement, a case was
opened to help Tina Briggs obtain the back child support in 2001. Since
that time, David Briggs had been taken to court regarding the child
suppport six times, and each time, he was ordered to pay the $49 along
with the support that was past due. Daily also pointed out that only
$412 had been paid since the case was opened in 2001, which includes
$50 in both October and November of this year. The defense put forth no
witnesses to discredit the prosecutions claims, and the jury quickly
returned with a guilty verdict. During closing arguments, Deputy
Prosecuting Attorney Richard Garrett told the jury that Briggs would
likely only spend one-sixth of his time in prison due to good time
accumulation. "I ask you to go back there and do what you feel is
right," he said. Briggs' attorney, Gregory Crain, told the jury, "Go
back there and consider how long you want this child to not get a
chance for support."

How many billions do they squander every year?

This is a prime example of why the system is so screwed up. They are
going to spend $230,000 (approximate cost to hold a prisoner for 10
years) to try to collect $14,000? If children were REALLY the focus,
wouldn't they fork over the $14K then try to collect that from someone
that has a chance of producing income? For what they are spending to
punish him, they could support his family, him, put him through
college so he could get a high paying job and have change left over!
They could consider it a loan and have a fighting chance of getting it
all back. I'm not in favor of using the government to "rescue" people
like that but it seems like a much better way to spend that 1/4 of a
million dollars.

Concidering that this whole C$ scheme was pushed thru as a money saving plan
for tax payers, where is the savings?

How many billions more of our tax dollars does the federal government spend
on these CS enforcement agencies? What did people expect when courts set
CS rates so high that they can't realistically expect to collect from
people that don't have much money?


When will they learn the difference between a deadbeat that is someone with
money that refuses to pay, and a deadbroke that is someone with no money and
no ability to pay?

When are women going to learn that there is no Night in shining armour that
is expected to pay for all their needs?

A "deadbeat" is someone who refuses to pay a legitimate debt. "Child
support" is NOT such a thing.

How is Child Support not a legitimate debt?
Are you saying your children "chose" to eat and do not have to?
Some people make me sick, it takes 2 to bring a child into the world and it
takes 2 to support them.

I am not saying rip off the NCP but dam they have a DIRECT Responsibility to
help support the child they help bring into the world.

People like this seem to think its always the governments responsibility to
support them and welfare in an entitlement!

Get a grip and help support your children!

I get 195 a month for 3 children though some of you may think that is a lot,
let me tell you that it doesnt touch the bills directly related to the
children. I pay out 170 a month out of my check to "ADD" the children to my
health insurance that leaves me less than $30 to feed, clothes pay for
school outtings, musical instruments for school, and everything else... I
estimate the children cost me additional $1400 a month (above the amonth of
child support) These cost are direct costs. While I cant start to add up
the indirect costs (my current wife has cut her work hours to work with my
children as they require most of time - my middle child is disabled and
needs just about full time care)

Basic support--for the children's cost of food, shelter, clothing,
medical--is one thing. Musical instruments, sports, etc--voluntary
activities--anre another. People on both sides of the issue are being
harmed by the current system--like it or not, it is NOT a good or fair
system. Why is only $195 per month allotted for 3 children?

Why two? My father raised 3 kids on one blue collar salary?

No that really leaves $230, remember you have to pay your share too!

OK, so please give us a basic breakdown of where $1,600 is spent directly on
your kids?
I know when I was growing up, sure as hell my folks were not spending $20
bucks more than the basics.
I was lucky to get $2/mth for my Scouting fees. You people ever heard of
the word, "NO"?
