CP Spends support on self, can kids sue CP?
A little background:
I got a better paying job a little over 5 years ago. CS went up significantly. What I pay now is 162% of what I paid before. I did this through a more demanding but better paying job. Her response was "It's better than nothing". Shortly after this increase, she got herself a more sporty car. When the kids turned old enough to drive, they had to go to work after school so they could buy their own insurance. After a couple of years, the sporty car wasn't good enough and the CP bought herself a sport car. So the CP makes half of what my income is (but she gets 32% of my take home pay) but yet she can afford to buy a sport car and insurance for herself and the kids have to pay their own way by working after school. Anytime the kids need school clothes or anything else, she calls asking for extra money. I ask her what happened to the extra support she got and she tells the kids that I don't want to help. So, the oldest is now 18 and just Graduated HS this year. She had a party afterwards and I didn't attend because I prefer to stay away from her mother. I eMailed her and told her about the increase in support her mom got, and I didn't see any of the increase money being spent on them, and her mom asking for money at every occasion, etc etc. She said she figured out years ago that their mom was spending their money on herself... Anyway, it doesn't bother me if their mom spends some of the support on herself, after the kids ride in her car, etc. But when she buys herself luxuries with their money and then asks for more money for them and tells them they have to work because I don't want to help... Question, could the 18 year old sue her mom for her 1/3 of the 62% increase that their mom received for over 5 years and didn't spend on them? I'm still paying the same support and her mom wants her to start paying to live there since she's 18 and out of school. I don't know that we'd really go through with it but if the mom knew she could be sued for the support she's blowing on herself she might ease off the kids. Thanks! Roger N |

The money is for the CP to spend as she pleases. The minor kids have no legal rights to the CS. Sorry. That's just the way it is. As long as the kids are provided their basic needs, the CP's legal obligation is met. Some states permit an audit of the money if there is reason to believe it is being mis-spent but few define "mis-spent" and such audits are usually reserved for mega CS awards. Judges simply don't want to be bothered with cumbersome details. |

It's sad that they want to crack down on deadbeat NCP's but don't give a rats behind if the CP uses the money for the children or drugs or anything else. We need a good TV commercial about a CP getting support money, making her kids go to bed filthy and hungry as she leaves them alone and blows their money partying!
