(SACRAMENTO) — State Senator Carole Migden’s bill making it easier and
faster to release the case files of deceased children who die as the
result of abuse or neglect passed the Assembly Judiciary Committee
yesterday on a bipartisan vote of 9-0.

The intent of SB 39 is to allow stakeholders in foster care and child
protective services to obtain data and information needed to produce
informed analyses about the most effective ways to reform a system in
which scores of children die each year. Due to California’s
confidentiality laws, it is a Herculean task to obtain case files that
contain this essential information.

The presumption of confidentiality in existing law was first created to
protect children who, through no fault of their own, came under the
jurisdiction of California’s child welfare system. The unintended
consequence of current law has been to force child advocates to file a
full-blown lawsuit in order to obtain even basic information surrounding
the death of a child -- and the current legal standard for disclosure is
so vague that litigation is lengthy and expensive

“It is ironic and it is wrong that current law bars the public from
understanding the ways in which California’s most vulnerable children
are not protected and the reasons why these deaths continue,” said
Migden. “The questions that SB 39 seeks to answer are why and what
reforms are therefore necessary to prevent such tragedies.”

In 2002, the last year for which statistics are available, 140 children
died as a result of abuse and neglect while under the jurisdiction of
California’s child protective services and foster care systems.

SB 39 creates for the first time an administrative process whereby the
most highly probative documents affecting a child’s death will be
released without the petitioner having to resort to filing a lawsuit. SB
39 then goes a step further and significantly improves the current legal
process by which the public can obtain the complete case file of a
deceased child.

SB 39 will improve California’s child welfare systems by proving
accurate information about investigations, findings and conclusions,
which will effectively hold our courts and child welfare agencies
accountable for their performance.

DAILY BASIS THEN ALL OTHER AGENCIES COMBINED INCLUDING THE NATIONAL

It is sickening how many children are subject to abuse, neglect and even
killed at the hands of Child Protective Services.

These numbers come from The National Center on
Child Abuse and Neglect in Washington. (NCCAN)
Recent numbers have increased significantly for CPS

*Perpetrators of Maltreatment*

Physical Abuse CPS 160, Parents 59
Sexual Abuse CPS 112, Parents 13
Neglect CPS 410, Parents 241
Medical Neglect CPS 14 Parents 12
Fatalities CPS 6.4, Parents 1.5

Imagine that, 6.4 children die at the hands of the very agencies that
are supposed to protect them and only 1.5 at the hands of parents per
100,000 children. CPS perpetrates more abuse, neglect, and sexual abuse
and kills more children then parents in the United States. If the
citizens of this country hold CPS to the same standards that they hold
parents too. No judge should ever put another child in the hands of ANY
government agency because CPS nationwide is guilty of more harm and
death than any human being combined. CPS nationwide is guilty of more
human rights violations and deaths of children then the homes from which
they were removed. When are the judges going to wake up and see that
they are sending children to their death and a life of abuse when
children are removed from safe homes based on the mere opinion of a
bunch of social workers.

I am not a member of this group yet, I am a grand parent who was also
the foster parents of my own grand children, I didnt know if that
counted here. or if there is a group for grand parents who have had
custody of there grand children given to them from the courts. can you
let me know. thank you. pamela pelham

I don't know of any groups specifically for Grandparents who are foster
parents, but anything is possible.

Beware, grandparents are commonly used for temporary custody
while the agency works at terminating the parental rights.
Often the grandparents are promised they can keep the kids,
and most of the time this is a huge lie.

Lots of grandparents have been duped in this way.

The grandparents expect that once the parents are
terminated they can adopt the kids, but the trick is that
once the parents are TPR'd away from the kids, you
have ALSO lost standing as family.

If you have a good attorney and they have filed
a Motion to Intervene and got you in as a party
to the case, this helps.

Ask your attorney to guard against this trick.

Grandparents can be a great help for families
to be restored, guarding the child against the
abuses the agencies would put them through.

If the agency suspects the grandparents will
stand against them like this, they will try
to prevent the grandparents from being
kinship caretakers or parties to the case.

Sometimes grandparents fall for various
dishonest promises as I described, and
join in with the agency against the parents
thinking they will benefit.

Then after TPR they get a big shock.

They realize they got CONNED into making
the situation for the kids WORSE, feeding
the Foster contractor system more kids.

Talk to your lawyer about protecting the
children against this deception by the agency.
