Write in a favorable letter supporting a current bill in California
that would correct many injustices. Cross post to your favorite groups.


Text of form letter:

Dear Senate Judiciary Committee:

I am writing to urge you to pass SB 1082, which you will vote on
Tuesday, April 19.

I support SB 1082 because it will help correct a terrible injustice
currently faced by activated reservists and National Guardsmen who are
noncustodial parents.

Today these service personnel can return from deployment overseas to
find themselves hopelessly in arrears on child support or even facing
jail. Others are taken advantage of terribly in custody matters while
they are deployed.

American patriots should not be subjected to injustice while fighting
for freedom abroad.

Actually you should rephrase that to read that any American should not be
subjected to injustice.

Is it fair that poor people should be used to promote a politician's
ambitions by claiming they have solved the poverty problem by throwing poor
people into jail that do not make enough money to pay thier CS?

How about a politician that runs on a platform of throwing any single male
parent in jail that doesn't earn $24,000/year!
Think they'll get elected or keep their job if they support such a platform?

will likely end

country they live in.

I cannot speak for America, but in Canada no one goes to jail for not
paying support per se.
They go to jail for refusing to comply with court orders. In other
words, if you make 5 dollars a day
and the judge ask you to pay 2 cents a month in child support, you must
do so. Failure to comply can cause you to go to jail.

I agree that no one should go to jail because they are poor, but if you
are poor and only make 400 dollars a month, that doesn't mean that you
cannot pay 5 dollar a month in child support. There is a segment of
society that believes because they make very little money, they don't
have to pay child support. Not so at all. Everyone no matter how poor
can pay some money in child support. If you are bright enough to get a
woman pregnant, you are bright enough to make a contribution to the
offspring no matter how poor you are.

Society in general does not mind you increasing global population but
society does mind you asking your neighbours to pay for your child
support.

Guess what, today's poverty level in America is rated about $1200 per month,
but a poor NCP would still be expected to pay the minimum support level of
about $400 per month. Most poor NCP's are already working two jobs just to
keep up with rent and other bare essentials. I don't have any sympathy for
NCP's that make a good buck and refuse to pay, but they are not the
majority. Soldiers who exist on military pay and cannot work another job
while on active duty should be excused from their high rate of CS payments,
this is where the Government should step in and "help"!!!!!

It's just so much easier for the government to ignore their responsibility
and throw poor people in jail rather than help them!

Every man should be excused CS payments. It is
just a backdoor tax.

should they pay based on their old salary before they were called to
active duty, this applies to reservists.

This issue is the ability to quickly modify a CS order downward based
on a significant change of circumstance. Failure to comply with a court
order is a very selectively enforced law. It is enforce with regard to
CS, but is rarely enforced with regard to visitation.

The question is about downward modification, paying no child support is
not the issue.

Your neighbors are not paying the CS. Once again, the issue is not
paying CS, but getting a timely downward modification. You must have
this modification becuase the Bradley Amendment will not allow a judge
to forgive CS that is accruded do to inaccurate awards based on
inflated income.
