Default Arrerage

arrerage is to goto whom if the child is emanciapted me or my son i'm being sued and may get criminal charges because my son was emancipated and arrerage checks still come to me in my name he's filing criminal charges against me and the county stating child support is in the name of the child and since he was emancipated the checks still come in my name and ive been cashing them any help or do i need an attorney this is Indiana?

I'm not an attorney, but arrearages are generally paid to the custodial
parents - if the CP was supposed to have been receiving them
originally.

That having been said, if I were a non-custodial parent who had
arrearages owed for the benefit of an emancipated child, I'd either pay
the arrearages to the emacipated child or not at all.

Indiana is one state who's Supreme Court has realized that arrearages
owed on an emancipated child constitute a debt...they won't jail a NCP
for not paying in such a case.
